Your rights under South African gambling law, how to resolve disputes with bookmakers, self-exclusion, and where to get help.

Your Rights as a Player

Fair Play

Licensed operators must ensure all games and bets are conducted fairly. Odds must be transparent, and outcomes must not be manipulated.

Right to Winnings

If you place a lawful bet and win, the operator must pay you. Gambling debts from licensed activities are legally enforceable under Section 16 of the NGA.

Self-Exclusion

You have the right to exclude yourself from gambling. The National Register of Excluded Persons allows you to bar yourself for a minimum of 6 months.

Deposit Limits

Licensed operators must offer deposit limit tools. You can set daily, weekly, or monthly deposit caps on your account.

Privacy (POPIA)

Your personal data is protected under the Protection of Personal Information Act. Operators must have clear privacy policies and cannot share your data without consent.

Right to Complain

You can complain to the provincial gambling board if an operator fails to meet its obligations. Boards have the power to investigate and impose penalties.

Dispute Resolution: Step by Step

Contact the Operator

Start by contacting the bookmaker's customer support. Document everything: take screenshots, save chat logs, note reference numbers. Most disputes can be resolved at this stage within 7-14 days. Be clear about what you expect as a resolution.

Escalate to the Provincial Gambling Board

If the operator does not resolve your complaint, contact the gambling board that issued the operator's licence. Include: operator name, your account details, a description of the dispute, all correspondence, and any supporting evidence. The board will investigate and may hold a hearing. Further Escalation

If the provincial board does not resolve the matter, you have several options:

  • National Gambling Board: info@ngb.org.za
  • National Consumer Commission: File a complaint under the Consumer Protection Act
  • Small Claims Court: For disputes under R20,000 (no lawyer needed)
  • Magistrate's Court: For larger amounts

No Gambling Ombudsman in SA

South Africa does not have a dedicated gambling ombudsman. The provincial gambling boards serve as the primary alternative dispute resolution mechanism. For disputes with offshore/unlicensed operators, there is no legal recourse, as these operators fall outside SA jurisdiction.

Self-Exclusion in South Africa

The National Gambling Act provides for a National Register of Excluded Persons, maintained by the National Gambling Board. Self-exclusion allows you to ban yourself from all licensed gambling activities.

How to Self-Exclude

Complete NGB Form 1/1, available from the National Gambling Board or any provincial board. Submit it with a copy of your ID. Since March 2026, operators must submit your request to the NGB within the same day.

Duration

Minimum exclusion period is 6 months. You can request longer periods. To be removed from the register after your exclusion period, you must apply and may need to provide proof of counselling.

Common Disputes

Withheld winnings (FICA incomplete)Complete your verification documents. If the operator is withholding verified winnings, escalate to the gambling board.
Account closureOperators can close accounts for valid reasons (bonus abuse, multiple accounts, FICA failure). If closure is unjustified, file a board complaint.
Bonus terms disputesReview the full bonus terms and conditions. If the operator changes terms after you accepted, this may be grounds for a complaint.
Technical malfunctionOperators must have procedures for handling technical issues. In September 2025, Hollywoodbets successfully required 159 players to repay R13 million from a Betgames malfunction.
Withdrawal delaysCheck FICA status first. Standard withdrawal processing is 24-72 hours. Delays beyond this can be escalated to the board.
