What does South African law say about online casinos?

The National Gambling Act 7 of 2004 is the primary legislation governing gambling in South Africa. It establishes the licensing framework for casinos, betting and bingo through provincial gambling boards. The Act does not include a licensing category for interactive online casino gambling.

Section 11 of the National Gambling Act prohibits interactive gambling (which includes online casino games) unless conducted under a licence issued under the Act. As no such licence category has been created for online casinos, no operator can legally hold such a licence. This means:

  • No online casino is legally licensed to operate for South African players.
  • Offshore casinos targeting South Africa operate without South African regulatory oversight.
  • Players at offshore online casinos have no recourse to South African regulatory authorities in a dispute.

What about the Interactive Gambling Bill?

South Africa has been discussing online casino regulation for several years. The Interactive Gambling Bill proposes to create a licensing framework for online casinos. However, as of March 2026, this Bill has not been enacted into law. Until it is passed and regulations are gazetted, the current prohibition position applies.

This site will report on any material legislative developments. Check the regulation updates page for the latest status.

Why this site does not link to offshore online casinos

Some South African gambling affiliate websites promote offshore online casino operators with affiliate links. This site does not do so, for two reasons:

  1. Legal clarity: Online casino gambling is not lawful in South Africa. Promoting activity that falls outside the legal framework is inconsistent with our editorial standards.
  2. Consumer protection: South African players using unlicensed offshore operators have no regulatory protection. Complaints cannot be taken to a provincial gambling board. Disputes are governed by the operator's own terms under a foreign jurisdiction.
